In-N-Out, the popular burger chain, has recently introduced new mask guidelines for its employees in five states. According to leaked internal company emails, starting from August 14, workers in Arizona, Colorado, Nevada, Texas, and Utah will be prohibited from wearing masks unless they have a doctor’s note. This move has sparked debates among health experts and raised concerns about compliance and potential violations.

The company’s rationale behind the new policy is centered on customer service, emphasizing the importance of showcasing employees’ facial expressions while considering the well-being of all individuals. However, some public health officials, including infectious disease specialist Dr. Judy Stone, have criticized the requirement for a doctor’s note, stating that it could be burdensome and potentially infringe on the Americans with Disabilities Act. Additionally, citing statistics from the Centers for Disease Control and Prevention (CDC), experts warn that a significant portion of adults have chronic diseases, which puts them at higher risk for severe COVID-19.

California and Oregon, which have laws preventing employers from banning masks, will also see updated mask guidelines for In-N-Out employees starting on the same date. Unlike the other states, workers in California and Oregon will have the option to wear masks in stores. However, the masks provided by the company must be N-95 masks, and those wishing to wear different masks must provide a valid medical note.

It’s worth noting that In-N-Out has faced previous controversies regarding safety measures during the pandemic. In 2021, the chain faced fines and temporary closures in California due to its reluctance to enforce COVID-19 vaccination rules.

The implementation of new mask guidelines at In-N-Out has generated mixed reactions from health experts and the public. While some states are banning mask-wearing without a doctor’s note, others, like California and Oregon, will allow employees to make their own choice, provided they adhere to certain mask specifications. As the situation evolves and in consideration of local health regulations, In-N-Out continues to evaluate and adapt its policies accordingly.
